You can sell just about anything that people are willing to pay for. I'm sure that at some point in the past, somebody has paid somebody else for a reservation. I'm sure that it will happen again at some point in the future. I'm also sure that there will be no legal action as a result. If you tried to do this on a significant scale, the restaurant might try to legally stop it in some way.Restaurants often encourage this, as otherwise their booked customer(s) would lose their booking deposit(s). It is often the same with holiday travel, and accommodation.
